Dangerous Driving

Dangerous driving is one of the most serious road traffic offences. If you are prosecuted for this offence, it could be dealt with in the Magistrates’ Court or in some cases, the Crown Court.

There is an increasing trend to press charges for Dangerous Driving when the real issue is driving at high speed. The Police will attempt to show that at speeds well in excess of the limit, there is a high risk of damage and/or injury and so the offence amounts to dangerous driving.

Conviction will result in an immediate driving ban - the current minimum is 1 year and you must then retake your driving test. You could also face up to 2 years imprisonment.

Death by Dangerous Driving

Causing Death by Dangerous Driving is arguably the most serious road traffic offence and it will always be dealt with at the Crown Court.

Conviction for causing death by dangerous driving could mean a custodial sentence as high as 14 years imprisonment. The current minimum for death by dangerous driving is 2 years. Conviction will also result in an immediate driving ban and an obligation to take a further driving test.
